Welcome to SRS Gym. These Terms of Use ("Terms") govern your access to and use of the SRS Gym mobile application (the "App") operated by SRS Gym ("we," "our," or "us"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Eligibility

You must meet the following requirements to use the App:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the App under applicable laws
  • Provide accurate and complete registration information

3. Account Registration and Security

3.1 Account Creation

To use certain features of the App, you must create an account by providing:

  • Valid email address
  • Full name
  • Phone number
  • Secure password

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information is accurate and up-to-date

3.3 Account Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activities
  • Provide false or misleading information
  • Abuse or misuse the App

4. Products and Services

4.1 Product Information

We strive to provide accurate product descriptions, images, and pricing. However, we do not warrant that product descriptions, images, or other content are accurate, complete, reliable, current, or error-free.

4.2 Pricing

  • All prices are displayed in the local currency
  • Prices are subject to change without notice
  • We reserve the right to correct pricing errors
  • Promotional prices are valid for the specified period only

4.3 Product Availability

Product availability is subject to change. We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion.

5. Orders and Payments

5.1 Order Placement

When you place an order, you:

  • Make an offer to purchase products at the listed price
  • Agree to pay all applicable charges including taxes and shipping
  • Authorize us to charge your payment method
  • Receive an order confirmation email (not acceptance of your offer)

5.2 Order Acceptance

We reserve the right to accept or reject any order for any reason, including but not limited to:

  • Product availability
  • Pricing errors
  • Suspected fraudulent activity
  • Inability to verify payment information

5.3 Payment Processing

Payments are processed through CyberSource Hosted Checkout. By providing payment information, you represent and warrant that:

  • You are authorized to use the payment method
  • The payment information is accurate and current
  • You will pay all charges incurred

5.4 Order Cancellation

You may cancel an order before it is shipped. Once shipped, cancellation is subject to our Return Policy. We reserve the right to cancel orders for reasons including:

  • Product unavailability
  • Pricing errors
  • Payment issues
  • Suspected fraud

6. Shipping and Delivery

  • Shipping times are estimates and not guaranteed
  • Risk of loss passes to you upon delivery
  • You are responsible for providing accurate shipping information
  • Additional customs fees or import duties may apply for international orders

7. User Conduct

7.1 Prohibited Activities

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful code, viruses, or malware
  • Attempt to gain unauthorized access to the App or systems
  • Interfere with or disrupt the App's operation
  • Use the App for fraudulent purposes
  • Impersonate any person or entity
  • Collect user information without consent
  • Post false, misleading, or defamatory content
  • Engage in any form of harassment or abuse

7.2 User-Generated Content

When you submit reviews, ratings, or other content, you:

  • Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content
  • Represent that you own or have rights to the content
  • Agree that your content does not violate any laws or third-party rights
  • Understand that we may remove content at our discretion

8. Intellectual Property

8.1 Our Rights

The App and its content, including but not limited to text, graphics, logos, images, and software, are owned by or licensed to SRS Gym and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the App for personal, non-commercial purposes. This license does not include:

  • Resale or commercial use of the App or its content
  • Modification, copying, or distribution of the App
  • Use of data mining, robots, or similar data gathering tools
  • Reverse engineering or decompiling the App

9. Third-Party Services

The App may contain links to third-party websites or integrate with third-party services (Google Sign-In, Facebook Login, CyberSource). We are not responsible for:

  • The content or practices of third-party services
  • Any damages or losses caused by third-party services
  • The availability or functionality of third-party services

10. Disclaimers

10.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Warranty

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • Results from using the App will be accurate or reliable

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SRS GYM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless SRS Gym, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your user-generated content

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Palestine, without regard to its conflict of law provisions.

13.2 Jurisdiction

Any disputes arising out of or related to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Salfit, Palestine.

13.3 Informal Resolution

Before filing a claim, you agree to contact us at sartawisrs@gmail.com to attempt to resolve the dispute informally.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

15. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the App will cease immediately
  • You must cease all use of the App
  • Provisions that should survive termination will remain in effect

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and SRS Gym regarding the App and supersede all prior agreements and understandings.
